1. Subject

The landlord gives for rent to the tenant Land van Engelingen, located at Helshovenstraat 33, 3840 Borgloon, Belgium. The beautifully renovated watermill is suitable for up to 24 people. It has been completely redecorated with ecological materials such as pottery, and it contains the following attractive houses:

The Country House

2. Acceptance good condition

The landlord offers the property and the tenant accepts the property in the condition as it is, in good state of maintenance, safety, hygiene, and habitability and following both royal and local laws and decrees, which apply.

3. Destination and use

3.1 The property is exclusively intended for occupation based on seasonal rental. The tenant cannot make this property his principal residence. Any modification by the tenant to the destination or use of the property is not allowed. 3.2 It is not allowed to occupy the property with more than the stated maximum number of persons. Likewise, no tents, caravans, or motorhomes are permitted. If this number is exceeded, 25% of the rent per additional person will be charged and deducted from the deposit. 3.3 State of the property: The rented property will be thoroughly cleaned and brought into a clean condition before use. When leaving the property, the house must be returned in a clean state to be delivered. For final cleaning, we assume that you put everything back in its place before departure if necessary, the dishes are done and all used household appliances and plumbing is cleaned and you leave the beds as you found them. The rented bed linen has to be collected in the entrance hall before departure. Failure to comply with these conditions may result in additional cleaning charges.

4. Transfer and subletting

The tenant is not allowed to transfer his rights, nor to rent the property to third parties.

5. Payment and conditions

5.1 A reservation is made by email or in writing and after a confirmation email from “Land van Engelingen”. 5.2 The rental price is mentioned on the page “Rates”. Before a booking becomes definite, 50% of the rent has to be paid. The remainder of the rent must be paid at least 6 weeks before the property is put into use. 5.3 The landlord’s obligation to provide access to the property is postponed until the rent has been paid in full, and the signed lease is in possession of both parties. 5.4 In case of late payment, the tenant is in default. The landlord shall notify him of this in writing. He then still can pay the amount due within 7 days. If payment is still not made, the lease is canceled on the day of the default. The prepaid amount of 50% is then considered as cancellation costs. 5.5 If the tenancy agreement within 6 weeks before the day of commencement is established, the entire rent must be paid immediately. 5.6 The landlord reserves the right to terminate the agreement due to important circumstances. In that case, the tenant will be informed as soon as possible of the cancellation of the lease and will be refunded the rent already paid within two weeks after cancellation.

6. Usage and costs

6.1 Final cleaning is included. 6.2 Bed and kitchen linen are included in the price as well as the service costs (water, electricity, gas, garbage bags). Bath towels and bath products are available in the bathroom. The beds are made on arrival. Under no circumstances may the beds be used without extra bed linen. Failure to comply with these conditions may result in additional cleaning charges. 6.3 The tenant undertakes to treat the rented property and its contents in all situations as a good family man. This includes closing windows and doors in case of wind/rain, locking the house in the absence, and the reasonable use of water, electricity, and heating. In the case of excessive consumption, this will be deducted from the paid rental deposit.

7. Waste disposal

Please deposit the sorted garbage bags outside in the sorting street at the parking lot. Waste of fruit and vegetables belong to the compost heap.

8. Deposit

8.1 To ensure a successful conclusion of the lease, the tenant pays a rental deposit of €500 to the landlord before he is allowed to use the property. The rent guarantee will be deposited at least 6 weeks before starting the contract on the landlord’s bank account, but we recommend to deposit it together with the rent. 8.2 The landlord’s obligation to provide access to the property is postponed until the rental deposit has been paid in full. In the absence of payment, the agreement on the effective date will be regarded as dissolved. The deposit is entirely separate from the rent to be paid. 8.3 If both tenants and landlords agree after the rental period, this deposit can be used to settle for the consumption costs and any shortcomings. See also ‘Rental Instructions’. 8.4 The landlord will refund this deposit (possibly less all consumption costs) within 4 weeks after the rental period if no damage has been done. Any bank charges associated with this (please note: with the correct use of the IBAN data, a bank transfer within the EU is free of charge) will be charged to the tenant.

9. Tenant liability

9.1 The tenant is liable for damage to the vacation home caused by himself and/or by his travel companions or visitors. During the rental period, he is responsible for the house and he undertakes to keep the house clean and tidy. It is recommended to take out a separate travel insurance in addition to the own civil liability insurance. 9.2 The tenant cannot accommodate more or other persons or animals in the vacation home than those mentioned on the contract. In that case, the owner may refuse the tenant. 9.3 The tenant is responsible for all forms of damage, including contents as determined by the landlord at the end or after the rental period. 9.4 All damage must be reported to the landlord before the departure of the tenant. 9.5 In case of no damage, the rental deposit will be refunded within 4 weeks after the expiration of this contract by the landlord to the tenant via bank account, after deducting any charges or costs.

10. Visit of the landlord

Through an appointment with the tenant, the landlord is allowed to visit the property to check whether all obligations are carried out. This right must take into account the tenant’s private life and must be carried out in moderation.

11. Responsibility in case of accidents and burglary

11.1 The landlord is not responsible for accidents that happen in and/or around the house. 11.2 The tenant is responsible for the theft of and damage to the contents if the theft occurs without traces of fallow. In case of robbery without traces of fallow, e.g., by not locking windows and doors in the absence, the tenant is liable for the damage suffered.

12. Miscellaneous

12.1 Any printing errors in this contract, our website, or other forms and documents are subject to change. 12.2 The landlord reserves the right to make changes by means of errata. 12.3 The landlord and mediator are under no circumstances liable and responsible for damage caused to all persons or movable and immovable property concerned. 12.4 The separate rental instructions form an integral part of this agreement. Please strictly follow all provisions.

INSTRUCTIONS

On arrival

The access code will be communicated to you the week before your stay. Please inspect the property on arrival and report any irregularities immediately. Also, check the inventory and report any shortages within 4 hours.

During your stay

We wish you a pleasant stay. Keep it also pleasant for your environment and the sleep and vacation life of your fellow residents. If you have any questions, please check this list or contact your contact person for further information.

At departure

When you leave our vacation home, please pay attention to the following:

  • Collecting the linen in the entrance hall.
  • Close all windows & doors. Leave the curtains open.
  • Empty the refrigerator and put it on stand 0.
  • Put the household goods in place and tidy up the dishes (washed clean) in the cupboards/drawers.
  • Leave dishwasher empty.
  • Empty garbage bins.
  • Dump all waste into the containers.
  • Sign our guestbook (you can do this by sending us an email); we are looking forward to your reaction.
  • Our team does the final cleaning.

We take care of the final cleaning; we assume that you will leave the estate swept clean when you leave.

  • Outside, the terrace and its surroundings must also be left clean (no food remains, no cigarette butts, …). If not, the costs will be deducted from the deposit.
